By accessing or using the DMV EVENT SPACE website, mobile application, or any associated services (collectively, the "Platform"), you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, you may not access the Platform or use any of its services.
If you are accessing the Platform on behalf of a company, organization, or other legal entity, you represent and warrant that you have the authority to bind that entity to these Terms.
DMV EVENT SPACE operates an online marketplace that enables registered users ("Hosts") to publish listings for commercial and residential spaces, and allows other registered users ("Guests") to discover, book, and pay for the short-term use of these spaces for events, meetings, and productions.
DMV EVENT SPACE is not an owner or operator of properties. We do not own, sell, resell, furnish, provide, rent, re-rent, manage, or control any of the properties listed on our Platform. Our responsibilities are limited to facilitating the availability of the Platform and serving as the limited payment collection agent of each Host.
To access certain features of the Platform, you must register for an account. By registering, you agree to:
- Provide accurate, current, and complete information during the registration process.
- Maintain the security of your password and accept all risks of unauthorized access to your account.
- Promptly notify DMV EVENT SPACE if you discover or suspect any security breaches related to your account.
- Be at least 18 years of age. The Platform is strictly not intended for users under the age of 18.
DMV EVENT SPACE charges service fees to both Hosts and Guests in consideration for the use of the Platform. These fees are calculated as a percentage of the total booking subtotal.
- Guest Fees: Displayed clearly at checkout before a booking request is submitted. Guest fees are non-refundable unless the Host cancels the booking.
- Host Fees: Deducted directly from the payout before the funds are transferred to the Host's connected bank account.
- Taxes: Hosts are solely responsible for determining their obligations to report, collect, remit, or include in their Listing Rates any applicable VAT, sales, or income taxes.
We may, in our sole discretion, permit you to post, upload, publish, submit, or transmit content such as text, reviews, photos, and video ("User Content").
By making available any User Content on or through the Platform, you hereby grant to DMV EVENT SPACE a worldwide, irrevocable, perpetual, non-exclusive, transferable, royalty-free license to use, view, copy, adapt, modify, distribute, license, sell, transfer, publicly display, and publicly perform such User Content to promote the Platform across any media formats.
You acknowledge that DMV EVENT SPACE acts only as a passive conduit for your online distribution and publication of your User Content, and we retain the right to remove any content that violates our policies.
To the maximum extent permitted by applicable law, the entire risk arising out of your access to and use of the Platform, your booking of any space, or your use of any space remains with you.
DMV EVENT SPACE, its directors, employees, or agents will not be liable for any incidental, special, exemplary, or consequential damages, including lost profits, loss of data, or personal or bodily injury or emotional distress arising out of or in connection with:
- These terms or the use of or inability to use the Platform.
- Any communications, interactions, or meetings with other users.
- The booking or use of a space, whether based on warranty, contract, tort (including negligence), product liability, or any other legal theory.
You and DMV EVENT SPACE agree that any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof will be settled by binding arbitration, and not in a court of law.
Class Action Waiver
You and DMV EVENT SPACE agree that each may bring claims against the other only in your or its individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding. Further, unless both you and DMV EVENT SPACE agree otherwise, the arbitrator may not consolidate more than one person's claims with your claims, and may not otherwise preside over any form of a representative or class proceeding.
